These terms and conditions (Terms) establish a legally binding agreement between you, whether as an individual or on behalf of an entity (referred to as “you”), and Scooteralia SL, a company registered at C/Asival 20, Palma, Spain, operating as Scooteralia (referred to as “we” or “Scooteralia”). Please read these Terms carefully before using the Scooteralia platform (PLATFORM), accessible through the website https://scooteralia.com (Site). These Terms exclusively govern the legal relationship between you and Scooteralia concerning the PLATFORM. It is important to note that when booking a vehicle (VEHICLE) rental (VEHICLE RENTAL) through the PLATFORM, you will also enter into a rental agreement (Rental Agreement) with the respective Rental Partner. Scooteralia shall not be held liable for any breaches of the Rental Agreement by the Rental Partner.
1.- BOOKING AND ELIGIBILITY
1.1 To reserve a VEHICLE RENTAL, you must meet the age and other eligibility requirements specified by the Rental Partner. Additionally, you are required to possess valid identity documents (e.g., passport or national ID card), a driving license, and a valid credit card.
1.2 VEHICLE RENTAL. Upon submitting a booking request (Booking), you may be asked to make a pre-payment (Booking Deposit). However, please note that the Booking is considered confirmed only after the Rental Partner approves it and you receive the reservation voucher (Reservation Voucher). Scooteralia reserves the right to decline or modify a Booking, including proposing an alternative Vehicle. The Reservation Voucher will be provided to you once you accept any proposed changes. Failure to pay the Booking Deposit may result in the cancellation of your booking. In case the Rental Partner rejects the Booking, the Booking Deposit will be refunded.
1.3 By completing the VEHICLE RENTAL booking form on the Site, you confirm that the information provided is accurate, the credit card used for payment belongs to you, and it has sufficient credit to cover the full cost of the VEHICLE RENTAL.
1.4 Scooteralia may request additional confirmation of the credit card details and driving license before confirming your Booking. Failure to provide the required confirmation or pay the Booking Deposit when requested may result in the cancellation of your Booking. Scooteralia reserves the right to deny further access to the Platform and seek compensation for any resulting losses.
1.5 The Reservation Voucher will include comprehensive information about your Booking, such as VEHICLE details, Booking Deposit amount, remaining balance for the VEHICLE RENTAL, and contact/meeting point details of the Rental Partner.
1.6 When collecting the VEHICLE, you must present the Reservation Voucher in either physical or electronic form. Failure to provide the Reservation Voucher upon request may result in denial of the VEHICLE RENTAL service. If you are unable to locate the Rental Partner representative at the meeting point, please contact the Rental Partner directly. Contact Scooteralia only if you cannot reach the Rental Partner.
1.7 Cancellations made outside the Rental Partner’s permitted cancellation period or significant breaches of these Terms may render the Booking Deposit non-refundable. Any eligible refunds will be processed after deducting administrative and bank fees, as well as any applicable charges for order cancellation or amendment imposed by the Rental Partner.
1.8 Changes to a confirmed Booking can be made within the Rental Partner’s permitted cancellation period. To request changes, you must receive a confirmation email from Scooteralia sent to your specified contact email address. Administrative charges for modifying your Booking will apply as follows: first change – free of charge, second and subsequent changes – 20 Euros. Please note that these administrative charges are in addition to any fees imposed by the Rental Partner for the requested changes.
1.9 Any extensions or reductions of the rental period after VEHICLE collection must adhere to the terms stated in the Rental Agreement and should be directly requested from the Rental Partner.
1.10 The minimum duration for VEHICLE RENTAL is 24 hours.
1.11 While Scooteralia advertises specific VEHICLE models on the Site, we cannot guarantee that you will receive the exact model and brand from the Rental Partner. However, the Rental Partner will make reasonable efforts to provide the VEHICLE specified in the Reservation Voucher. If necessary and subject to availability, the Rental Partner may substitute the VEHICLE with a similar one of the same or higher class under the same pricing conditions. Compensation for such circumstances should be sought from the Rental Partner in accordance with the Rental Agreement, as Scooteralia shall not be held responsible.
2.- PRICES AND PAYMENT METHODS
2.1 The prices for VEHICLE RENTAL services are published on the Site and become effective at the time of your Booking. The specific VEHICLE RENTAL cost will be confirmed in the Reservation Voucher. In case of any discrepancies in the pricing during the Booking process, you will be notified of any changes, and you may choose to accept or cancel the Booking. If a Booking is canceled, the Booking Deposit will be fully refunded, but no additional compensation will be provided.
2.2 The VEHICLE RENTAL price is stated in the Reservation Voucher, which forms an integral part of the Rental Agreement.
2.3 In addition to the rental price balance, the Rental Partner may request payment for additional services you have requested (e.g., VEHICLE insurance, extra helmets, etc.) at the time of signing the Rental Agreement.
3.- INSURANCE AND EXCLUSIONS
3.1 The insurance coverage for the Booking is provided by the Rental Partner, not Scooteralia. Please be aware that the insurance included in the Rental price may not cover common non-included options like:
Loss or theft of personal belongings. Loss of keys and documents of the VEHICLE. Damage to the VEHICLE’s chassis and wheel rims… and others. Make sure you read the Rental Partner terms & conditions policy.
Excess (responsibility on damages to the VEHICLE) are indicated in the contract.
3.2 The Reservation Voucher will detail your liability amount in case of a traffic accident or VEHICLE theft. You must adhere to the accident protocol outlined in the Rental Agreement and follow any instructions provided by the Rental Partner. Failure to comply may result in full responsibility for VEHICLE damages or the replacement value of the VEHICLE in case of theft.
3.3 The rental price does not cover fuel costs. Unless otherwise agreed with the Rental Partner, you are responsible for returning the VEHICLE with the same fuel level as received. Failure to do so may result in additional charges based on the fuel price specified in the Rental Agreement.
3.4 The rental price does not include fines or penalties imposed by traffic control authorities for non-compliance with traffic laws or regulations during the rental period. Any fines or penalties incurred by you or other drivers of the VEHICLE will be your sole responsibility.
3.5 All online credit card payments made on the Site are processed through a fully licensed bank and are secured using protective technologies such as Secure Sockets Layer/SSL and 3D. Your personal information will be treated as strictly confidential. Our privacy policy, available on the Site, outlines how we handle the collection of personal data, as well as your rights in relation to such data.
4.- PICK-UP AND RETURN OF THE VEHICLE
4.1 The VEHICLE will be provided to you in good technical condition, with the equipment and appearance as described in the Inspection Report, which is an integral part of the Rental Agreement. It is your responsibility to return the VEHICLE in the same condition as stated in the Inspection Report. Any missing items or damage to the rental equipment (such as GPS navigation device, riding gear, helmet, luggage rack, luggage carriers, panniers, pedals, pump, chain lock, luggage straps, camera, intercom, etc.) are not covered by the insurance, and you will be held liable for the full replacement cost. If the VEHICLE is returned unclean, you will be responsible for all cleaning costs.
4.2 You are required to collect the VEHICLE at the designated place and time specified in the Reservation Voucher. If you fail to collect the VEHICLE within 2 hours of the scheduled collection time, the Rental Partner may, at their discretion, terminate the Rental Agreement. In case you cannot locate the Rental Partner representative at the meeting point, you should immediately contact the phone numbers provided in the Reservation Voucher. Only if you are unable to reach the Rental Partner, you may contact Scooteralia using the contact details listed in the Reservation Voucher. Failure to register a call or email with the Rental Partner or Scooteralia will result in the cancellation of your Booking due to your failure to appear. In such a case, you will not be entitled to compensation, and you will be responsible for payment of the full amount of the Booking.
4.3 Neither Scooteralia nor the Rental Partner will be held liable for any losses you may incur due to delays (e.g., missed flights, trains, buses) during the collection or return of the VEHICLE.
4.4 Upon collection of the VEHICLE, you must present a valid driving license, a valid identity document (such as a national ID card or passport), and a valid credit card in your name. In certain countries, you may be required to present an International Driver’s License (IDL or IDP) if mandated by law. Failure to provide all the required documents and a valid credit card will result in the cancellation of the Booking due to your fault, and you will be liable to pay Scooteralia and/or the Rental Partner the full amount of the Booking as compensation.
4.5 You must return the VEHICLE in the same condition as when collected, along with all vehicle documents, at the agreed time and place specified in the Rental Agreement. The time and place for VEHICLE return should be confirmed with the Rental Partner at least 24 hours in advance. Scooteralia and the Rental Partner will not be held liable for any losses incurred by you due to delays in returning the VEHICLE.
4.6 If you exceed the specified return time by more than 60 minutes, you will be charged a default fee equal to one day’s rental, payable upon return of the VEHICLE. Delays exceeding 2 hours may result in the Rental Agreement being voided at the discretion of the Rental Partner, and standard daily rates may apply for the extended rental period if they are higher than the Rental price agreed upon in the Rental Agreement.
4.7 Failure to return the VEHICLE for more than 24 hours from the specified return time, regardless of the reason, will be considered misappropriation of the VEHICLE. The Rental Partner reserves the right to inform the relevant police authorities of your failure to return the VEHICLE. Additionally, upon eventual return of the VEHICLE, you will be charged the full daily rental amount from the contractual return date specified in the Rental Agreement until the actual return date.
4.8 The Rental Partner reserves the right to terminate the rental and collect the VEHICLE at any time, without notice and at your expense, if the VEHICLE has been used in violation of these Terms and/or the Rental Agreement. Scooteralia and its Rental Partners shall not be responsible for any additional costs incurred by you or other members of your party as a result of the termination of the VEHICLE RENTAL.
4.9 Scooteralia and its Rental Partners reserve the right to withhold the VEHICLE RENTAL if your behavior or the behavior of your party is disruptive or poses a safety risk to third parties. Scooteralia and its Rental Partners shall not be liable for any additional costs incurred by you and your party due to the denial of the VEHICLE RENTAL.
4.10 If you refuse to sign the Inspection Report upon VEHICLE return, the report will be unilaterally signed by the Rental Partner representative and witnessed by a third party attesting to your refusal. The findings in the Inspection Report will be binding on you, despite your refusal to sign, and may be used as evidence in legal proceedings.
4.11 In the event of a manufacturing defect or natural wear and tear resulting in VEHICLE malfunction, the Rental Partner will either repair or replace the VEHICLE. If a suitable replacement VEHICLE is not available, the Rental Partner will arrange transportation for you to the designated return point specified in the Rental Agreement, and you will be entitled to a full refund of the Booking amount. No further compensation will be due to you from either the Rental Partner or Scooteralia.
4.12 If the VEHICLE needs to be replaced due to damage caused by you, you will be responsible for all costs associated with the replacement of the VEHICLE and the rental cost for the period during which the damaged VEHICLE is out of service. The Rental Partners reserve the right to refuse a replacement VEHICLE if you have violated these Terms and/or the Rental Agreement.
5.- DAMAGE NOTIFICATION
5.1 In the event of an accident, injury, or damage, you must take all necessary measures to mitigate and reduce the damage to the VEHICLE in accordance with the VEHICLE’s insurance coverage requirements. Failure to do so may result in a one-time fee as specified in the Rental Agreement for default, damage, theft, or missing parts of the VEHICLE.
5.2 In the event of a traffic accident, damage, or theft of the VEHICLE, you must immediately notify the Rental Partner and, if necessary, the police authorities, regardless of whether you are at fault. It is your responsibility to obtain a full police report for such incidents. Failure to provide the Rental Partner with the required police report will result in full liability for any loss or damage to the VEHICLE or its replacement, as applicable.
5.3 If the VEHICLE is returned with damage or missing parts, the Rental Partner will retain the insurance deposit specified in the Rental Agreement and send the VEHICLE for inspection at an authorized service shop. Once the examination is completed, the Rental Partner will notify you (using the email address provided during the Booking) and issue an invoice for the cost of the VEHICLE repairs.
